Heard learned counsel for the petitioner, learned AGA for the State and perused the record.
Learned AGA submitted that the date of birth of corpus is 2.3.2002 as per educational certificate and she has been given in custody of father by order dated 4.4.2018 passed by C.J.M., Mainpuri and the efficacious remedy of filing revision against the order dated 4.4.2018 is available to the petitioner; that the writ petition for habeas corpus is not maintainable.
Learned counsel for the petitioner submits that the petition be dismissed as withdrawn with liberty to file revision.
In view of above, at this stage the writ petition is dismissed as withdrawn with liberty as above.
Let certified copy of the order dated 4.4.2018 passed by C.J.M., Mainpuri be returned to learned counsel for petitioner as per the Rules of the Court.
