Heard Sri Ramakant Singh, counsel for the petitioner, Sri O.P. Verma holding brief of Sri Dinesh Pathak, counsel for respondent no. 4 and learned AGA.
Learned counsel for the petitioner has moved withdrawal application stating that during the pendency of the petition guardians of both side have decided to resolve the matter out of the Court and thus, he wants to withdraw this petition in the interest of justice.
I may record that petitioner no. 2, the alleged husband of the corpus was directed to deposited Rs. 25,000/- before the Registrar General of this Court and thereafter notices shall be issued to respondent no. 4. Thereafter, matter has come up before the Court number of occasions and now an application for withdrawal has been moved and as the valuable time of the Court has been wasted in the matter I deem it fit to direct the Registrar General of this Court to forward the aforesaid amount in favour of Army fund to which learned counsel for the petitioner has no objection.
In view of the aforesaid, it is directed that the amount so deposited by petitioner no. 2 shall be forwarded by way of demand draft in favour of "Army Welfare Fund Battle Casualties" payable at New Delhi at the following address:-
"Director Accounts Section Adjutant General's Branch Ceremonial & Welfare Directorate IHQ of MoD (Army) New Delhi-110011"
