1- This criminal revision has been filed against the order dated 10.2.2005 passed by Principal Judge Family Court, Jhansi on an application under Section 125/127 Cr.P.C. in case no. 54 of 2003.
2- Heard Sri Arvind Srivastava, holding brief of Sri Sri Pushkar Srivastava, learned counsel for the revisionist and learned A.G.A. for the State and perused the record.
3- From perusal of the record, it transpires that in compliance of the order dated 06.07.2001 of this Court, on the basis of affidavit filed by the parties, the proceedings under Section 127 Cr.P.C. was stayed and condition for depositing the money was fulfilled. Hence, application under Section 127 Cr.P.C. was rejected with liberty to file a fresh application under Section 127 Cr.P.C.
4- From perusal of the record, it also transpires that application under Section 127 Cr.P.C. was rejected by the court concerned in compliance of the order passed by this Court.
5- This Court finds no illegality, impropriety, material irregularity or jurisdictional error in the impugned order dated 10.2.2005. No interference is called for. The present revision lacks merit and is liable to be dismissed. Hence dismissed.
6- Lower court record along with of this order be transmitted to the court concerned immediately.
