Heard Sri Brijesh Kumar Singh, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
The brief facts of the case as narrated in the F.I.R. are that first informant is resident of District Nagor, State of Rajasthan and had come for settling his marriage to the house of Kesha Ram and when he left on 10.7.2019 at 4.00 a.m two persons wearing police uniform after extending threat forcibly took Rs.24,500/- and then went away in WagonR. Later on, first informant came to know that they were constables ,Muneedra Yadav and Ragavendra Singh.
Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the present crime to teach a lesson. The allegations contained in the F.I.R. against the applicant are vague, bald and general in nature. The applicant has no criminal antecedent to his credit, therefore, he may be released on anticipatory bail.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that Kesha Ram who grabbed money from the first informant is in jail. The applicant who is a constable and whose duty is to protect public at large is involved in such type of offences, therefore, the applicant is not entitled to be enlarged on anticipatory bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant,Raghvendra Kumar Singh involved in Case Crime No. 74 of 2019 under Section 386 I.P.C., Police Station Ghorawal, District Sonbhadra as effective investigation is necessary in this case and the applicant may be put up for identification by the victim.
Accordingly, the anticipatory bail application is rejected.
