Heard applicant's counsel as well as learned AGA for the State and perused the record.
Submission of learned counsel for the applicant is that the allegations as have been made do not make out any offence of cheating against the applicant. There is hardly any material to substantiate that any wrongful monetary or otherwise loss has been caused to anybody. Further submission is that the applicant is not the guilty of causing any nuisance or hindrance to anybody. No details about the use of any fake Aaadhar card could be collected during the investigation. Further submission is that the submission of the chargesheet is wholly uncalled for and shall result in nothing except abuse of the court's process.
Contentions raised at the bar require detailed hearing on law and facts both.
Notice on behalf of opposite party Nos.1 and 2 has been accepted by learned AGA.
Learned AGA may file counter affidavit within a period of three weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List this matter immediately after expiry of the aforesaid period before the appropriate bench.
Till the next date of listing further proceedings of Case No. 16190 of 2018, arising out of Case Crime No. 0020 of 2018, u/ss 420, 290 IPC and Section 14 of the Sarais Act 1867, P.S.- Sadar Bazar, District Meerut. with regard to applicant namely, Raghuvir Singh shall remain stayed.
