In proceedings under Section 115-D of the U.P. Zamindari Abolition Act, 1950 an order was passed against the petitioner which was subjected to challenge by means of revision before the Collector, Unnao which has been dismissed by the order dated 18.1.2014.
It is the case of the petitioner that the order is exparte having been passed without opportunity of hearing being provided to him.
In view of the submissions made it would be appropriate to direct the petitioner to file a restoration application before the Collector. The plea of the order being exparte cannot be permitted to be raised before this Court at the first instance.
Accordingly and subject to the aforesaid observations, the writ petition is dismissed.
