The present application under section 482 Cr.P.C. has been filed seeking to quash the cognizance order dated 12.3.2021 passed by learned Additional Chief Judicial Magistrate-I, Agra and charge sheet dated 24.11.2020, arising out of Case Crime No. 404 of 2020, under sections 452, 323, 325, 504, 506 I.P.C, Police Station-Malpura, District Agra pending in the court of Additional Chief Judicial Magistrate-I, Agra.
Counsel for the applicant after making submissions to some extent fairly submits that the necessary ingredients for invocation of powers under section 482 Cr.P.C. are not made out in the facts of the present case and accordingly, he does not wish to press the reliefs as prayed for in the application, which are therefore, not entertained.
Learned counsel states that the applicant would submit to the jurisdiction of the court below and seek bail.
In case any such application for bail is moved by the applicant, the court below would be expected to dispose of the same in accordance with the settled principles of law.
Subject to aforesaid observation, the application stands dismissed.
