Raghuvansh Upadhyay vs State Of U.P. And Others

High Court Of Judicature at Allahabad|21 June, 2010

JUDGMENT / ORDER

Hon'ble Rajesh Chandra,J.
In paragraph 7, 10 and 11 of the writ petition it is admitted that Original Suit No. 1247 of 2004, Original Suit No. 1216 of 2004 Writ Petition No. 21260 of 2006 are pending between the parties in respect of the same property. Further from paragraph 16 it is admitted that Revision No. 959 of 2007-08 is pending before the Board of Revenue. Under the order impugned, the Sub Divisional Magistrate has only directed that the orders of the Courts be strictly complied with.
We are of the considered opinion that the order so passed does not in any way dilute the orders passed by the competent Courts in litigation between the parties, therefore, the present writ petition is totally misplaced. However if the petitioner, because of any action taken on the basis of the aforesaid order of the Sub Divisional Magistrate feels aggrieved, he is always at liberty to either approach the competent Civil Court or a writ Court or Board of Revenue in the pending matters, as he may be advised. Writ petition is dismissed.
