This is an application seeking expeditious disposal of Case No.1281 of 2011 (State Vs. Raghuraj Chaturvedi) (arising out of Case Crime No. 491 of 2010) under Section 419, 420, 467, 468 and 471 IPC, P.S.- Kotwali, District Jhansi.
The submission of learned counsel for the applicant is that he is the accused and therefore has a right guaranteed under Article 21 of the Constitution of India to speedy trial. This Court has no doubt about the said proposition and also about the fundamental right of the accused to speedy trial.
A perusal of the record shows that the case in question is triable as warrant case by a Magistrate where the crime relates to the year 2010 and the case is of the year 2011. Charges have now been framed on 22.05.2015 and thus, for the last three years, the case is up for hearing.
A perusal of the order-sheet shows that the same is proceeding at a lethargic pace. The C.J.M, Jhansi or to such other Magistrate this case is hereinafter made over shall now proceed with the trial most expeditiously and endeavour to conclude the same within a period of eight months next from the receipt of certified copy of this order, unless there be a stay order granted by a Court of Superior jurisdiction.
With the aforesaid orders this application stands disposed of.
