JUDGMENT / ORDER

1. By way of this petition, the petitioner has prayed for the following reliefs :-
"[A] Your Lordships may be pleased to allow this petition.
[B] Your Lordships may be pleased to declare that the petitioner is entitled to pension on the basis of salary last drawn by him on the post of Pump Operator and on such basis be pleased to further direct the respondent authorities to revise the present pension being paid to the present petitioner.
[C] Your Lordships may be pleased to declare that the petitioner is entitled to pension on the basis of salary last drawn by him on the post of Pump Operator and on such basis be pleased to further direct the respondent authorities to revise the present pension being paid to the present petitioner and pay all the arrears of pension upon basis of such revision of the scale of the present petitioner with interest at such rate as may be deemed fit and proper by this Hon'ble Court.
[D] Your Lordships may be pleased to declare that recovery of amount of Rs.65,128/- from the present petitioner was illegal and further be pleased to direct the respondent authorities to refund to the present petitioner amount so recovered along with interest on such rate as may be thought fit and proper by this Hon'ble Court.

2. Heard learned counsel for the petitioner. Pursuant to the directions of this Court, respondent no. 3 issued communication dated 15.02.2012 and fixed the pension of the petitioner on the post of Pump Operator. However, a grievance has been voiced that the respondents have not released the pensionary benefits so far.
3. Considering the facts of the case and the earlier orders of this Court, the respondents are directed to decide and release the entire amount of pensionary benefits of the petitioner within a period of FOUR WEEKS from today. It is, however, observed that if the pensionary benefits are not released within the stipulated time period, it shall be open to the petitioner to revive this petition.
4. With the above observation and direction, the petition stands disposed of. Direct Service is permitted today.
