1. Heard learned counsel for petitioner and learned Standing Counsel as well as Sri Pranjal Mehrotra, Advocate for respondents.
2. Petitioner was placed under suspension vide order dated 02.02.2018 whereagainst he filed Writ Petition No. 8885 of 2018 in which an interim order was passed on 29.03.2018 staying order of suspension but permitting respondents to continue with departmental inquiry. By means of impugned order dated 04.05.2018 Competent Authority in compliance of stay order has kept order of suspension in abeyance but petitioner has been posted in the office of Executive Engineer, Construction Division, U.P. Jal Nigam, Jaunpur.
3. Learned counsel for petitioner stated that petitioner is entitled to be posted at the same place where he was working at the time of suspension but despite repeated query, he could not show any right vested in petitioner to remain posted at a particular place.
4. By means of interim order dated 29.03.2018 only order of suspension was kept in abeyance and that has been complied by authorities. Wisdom of posting of an employee is the prerogative of employer and not to be chosen by employee. We, therefore, find no legal or otherwise right vested in petitioner to remain posted on his place of choice.
5. Writ petition lacks merit. Dismissed.
