Raghubhai vs The

High Court Of Gujarat|14 March, 2012

JUDGMENT / ORDER

1. The applicant has taken out present application seeking below mentioned relief:
"(B) Your Lordship may be pleased to permit the applicant to annex the documents as Annexures 'G','H','I' in the main special civil application and be pleased to fix the final hearing of the main matter in the interest of justice."
2. The petition has been preferred in 2007 and petition came to be admitted on 10.05.2007. The other old/senior matters are pending in the cause list for final hearing. If the request as prayed for is granted then it would amount to allowing out of turn hearing to the applicant. Under the circumstances, it does not appear appropriate, at this stage, to grant out of turn hearing by allowing the request made by the applicant. However, the office is directed to list the petition in the cause list of final hearing in due course and as per its seniority.
3. In view of the averments made and explanation given in the application and in light of the submissions made by learned Advocate for the applicant and considering the submissions by learned A.G.P. for respondent that the respondent authorities have no objection if the documents mentioned in the application are allowed to be placed on record of the petition provided opportunity to deal with the same is allowed, the applicant is permitted to place the documents annexed to this application as annexures to the petition on the condition that the applicant shall provide amended copy of the petition along with the newly added documents/annexures to all the three respondents. If the respondents consider it necessary to file further affidavit so as to deal with the said documents, the said opportunity is also granted to the respondents and such affidavit may be filed within four weeks from the date on which the amended copy along with new annexures is supplied.
4. With the aforesaid directions and clarification, the application is disposed of.
