Heard learned counsel for the petitioner; learned A.G.A. for the State-respondents; and perused the record.
The instant petition seeks a direction upon the third respondent to decide appeal as well as stay application pending as Appeal No.597 of 2018 against the externment order dated 06.12.2018 passed by the District Magistrate, Farrukhabad.
As the order of externment is operative for a period of six months only, the decision on the stay application as well as appeal ought to be with utmost expedition otherwise the very purpose of appeal would stand frustrated.
In view of the above, we deem it appropriate to dispose off this petition by directing the third respondent (Commissioner, Kanpur Division, Kanpur) to ensure expeditious disposal of the appeal, preferably, within a period of four weeks from the date a certified copy of this order is furnished upon him.
