Learned APP, Mr.Pandya, waives service of rule on behalf of the respondent-State.
By way of this application, the applicant-convict, through his wife, has prayed that the applicant-convict be enlarged on temporary bail to attend his ailing mother.
From jail report, it appears that the applicant-convict was on temporary bail on three occasions in last 3 months. The last one being ended on 1st February, 2012.
Considering the totality of the facts, we are not inclined to exercise the discretion in the present case.
Hence, the application is rejected. Rule discharged.
