Heard Mr. Pradeep Patel, learned counsel for the petitioner.
For the grievance raised in this petition about the inaction on the part of the respondent-authorities, initially Special Criminal Application No.1572 of 2011 was filed by the petitioner in which, by order dated 4.7.2011, the Coordinate Bench of this Court directed the District Superintendent of Police, Surendranagar, to consider the grievances of the petitioner. The above order was also served upon the office of the District Superintendent of Police, Surendranagar, by the petitioner. Initially, the In-charge Police Officer was directed to take appropriate action and to submit a report to the DSP, and, upon submission of such report that the accused had not committed any crime as alleged, no further action is taken.
This Court issued notice by order dated 16.12.2011 in this petition upon consideration of the relevant papers and the order passed earlier. Though the said order is also served upon respondent Nos. 2 and 3, no representation is made on behalf of respondent Nos. 2 and 3 and the learned APP, in absence of any instruction or information, is unable to assist the Court.
Since the order dated 16.12.2011 passed by this Court is already served upon respondent Nos. 2 and 3, and no representation is made, respondent No.3, the District Superintendent of Police, Surendranagar, is directed to personally remain present before this Court on 13.1.2012 at 11 a.m. S.O.
to 13.1.2012.
Copy of this order be given to the learned APP for due compliance.
