The petitioner challenges the revenue recovery proceedings initiated against the petitioner's property for satisfaction of a loan availed of from the 2nd respondent-Bank. Admittedly the petitioner committed default and an arbitration case [ARC No.1651 of 2004] was filed by the respondent-Bank, in which an award was passed. The award passed was executed through Munsiff Court, Koyilandy, in E.P.No.270 of 2007. The Bank purchased the property in the auction sale conducted by the Munsiff Court on 30.09.2009 and in such circumstance, nothing survives in the writ petition.
