The opposite party has appeared in person in compliance of order dated 29.8.2018. The defence taken by him is that he joined the post of Tehsildar Soraon, district Allahabad on 9.7.2018. As no Naib Tehsildar is posted at Nawabganj, Tehsil Soraon, therefore, he was having additional charge of Naib Tehsildar, Nawabganj. He is stated to have passed an order dated 31.8.2018 deciding the proceedings under Section 34 of the U.P. Land Revenue Act, 1901. Thus, according to the opposite party, not only the restoration application, which was directed to be decided by the Writ Court, but even the proceedings on merits have been decided.
The explanation furnished by the opposite party is found to be satisfactory. Accordingly, the notice issued to him is discharged.
The contempt application is consigned to record.
