This writ petition has been filed challenging the order dated 30.12.2013 whereby review application filed by the State of U.P. has been entertained. The earlier order dated 8.9.2013 dismissing the revision filed by the State, has been set aside and it has been directed that the revision shall be heard on merit. It may be clarified that proceedings from which the writ petition arises were under Section 122-B of the U.P.Z.A. & L.R.Act.
Since the review has been entertained and the matter has not yet been decided finally on merit as directed by the order impugned, I am not inclined to interfere with the impugned order in exercise of my writ jurisdiction at this stage.
It is however, provided that in case the revision is decided against the petitioner and occasion arises for him to challenge the order on merits he may challenge the same also on the ground that the review was illegally allowed.
The writ petition is accordingly disposed of.
