JUDGMENT / ORDER

The petitioner herein is the sole accused in C.C No.4220/2014 of the Judicial First Class Magistrate Court, Kodungallur. Crime in the said case was registered under Sections 341, 324, 294(b) and 506(i) of IPC on the complaint of one Somasundaran. The petitioner now seeks orders quashing the prosecution on the ground that he and Somasundaran have come to terms amicably out of court, and Somasundaran has no complaint or grievance now. The de facto complainant Somasundaran is the second respondent in this proceeding. He has filed affidavit to the effect that he has settled the dispute with the accused, and that he has no grievance or complaint now. I am well satisfied that the parties have really settled the whole dispute, and that continuance of prosecution in such a situation will be a sheer waste of time, because nobody will support the prosecution, if the case goes to trial. In the result, this petition is allowed. The prosecution as Crl. M.C No. 6902 of 2014 2 against the petitioner in C.C No. 4220/2014 of the Judicial First Class Magistrate Court, Kodungallur will stand quashed under Section 482 Cr.P.C. Accordingly, the petitioner will stand released from prosecution, and the bail bond, if any, executed by him will stand discharged.
