The petitioner has preferred this writ petition amongst other following reliefs :-
"Issue a writ, order or direction in the nature of mandamus commanding the respondents to allow the petitioner and other members of the Committee of Management of Nagar Sahkari Bank Ltd., Gorakhpur to continue till February, 2008 in view of the amendment brought in Section 29 of the U.P. Cooperative Societies Act, 1965 by means of Act No.30 of 2006."
At the time of admission of the matter, this Court has granted an interim order on 10.10.2007 and has stayed the appointment of the interim administrative committee and a direction was issued to the Registrar, Cooperative Societies, Lucknow to hold the election of petitioner's committee within three months. In the meantime, the Court has directed to continue the interim administrative committee with certain conditions. The writ petition is pending since 2007.
We have perused the material on the record.
It appears to us that the writ petition has become infructuous by efflux of time.
Accordingly, the writ petition is dismissed, leaving it open to the petitioner to move recall application, if the cause of action still survives.
