Heard learned counsel for the petitioner and learned Standing Counsel for respondents.
The petitioner was working as Meth on daily wage Muster Roll in National Highway, Khand-I, Public Works Department, Prayagraj and he was regularized on 14.03.2021 in pursuance of the order dated 31.01.2003 passed by this Court. He was retired from the post of Meth on 31.01.2021. Thereafter, the petitioner has approached the respondents to his pensionary benefits but pension has not been provided to the petitioner as admissible on the post of Meth. In this respect, several representations have been submitted to respondent-authorities requesting them to release the gratuity.
The grievance of the petitioner is that respondent-authority is sitting tight over the matter and has not yet released the pension to him.
Learned Standing Counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a comprehensive representation before the respondent no.3-Executive Engineer, National Highway, Khand I, Public Works Department, U.P. Prayagraj alongwith the copy of this order downloaded from the official website of High Court, Allahabad raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
