The appellant no.1 Radhey Sharan has been arrested and has been produced before this Court today by Head Constables Ramesh Singh and two others. He has made a statement that appellant no.2 Nanak Chand has since expired.
It is further stated that appellant no.1 Radhey Sharan will engage a counsel within a week who shall assist the Court when the matter is listed next.
The appeal is of the year 1991. Hearing of the appeal cannot be proceeded with for want of assistance on behalf of the appellants.
We, therefore, issue following directions.
(i) The appellant no.1 Radhey Sharan may engage a counsel within a week from today and thereafter make an application for bail before the Chief Judicial Magistrate concerned disclosing the name of the counsel. If this is done, the appellant no.1 Radhey Sharan may be released on bail on same terms and conditions on which he was granted bail under the order dated 25.4.1991. His future presence is exempted unless directed otherwise.
List on 15.9.2014.
Copy of this order be forwarded to the Chief Judicial Magistrate, Meerut and submit a report with regard to the death of appellant no.2 Nanak Chand as well as status report of bail application if any filed by the appellant.
