Order of termination dated 28.1.2021, contained in Annexure -11 to the writ petition, is challenged on various grounds.
Sri Vikas Budhwar, learned counsel for the respondent points out that there are standing orders which governs the service conditions of petitioner. Petitioner has a remedy of preferring appeal by virtue of Clause-5 of the Standing Order and that infact such an appeal has been preferred by the petitioner on 20.2.2021, which is pending.
Since the petitioner has an alternative remedy of filing appeal which has been availed of, as such, this Court is not inclined to entertain challenge to the order impugned in the present petition.
Law is otherwise settled that parallel proceedings ought not to be allowed.
In the facts and circumstances of the case, it would be appropriate to dispose of this petition requiring the appellate authority to dispose of petitioner's pending appeal, by way of a reasoned order, expeditiously, preferably, within a period of three months from the date of presentation of a copy of this order.
