Heard Sri Ravindra Prakash, holding brief of Sri Vimal Kumar, learned counsel for the petitioner and Sri Rohit Yadav, learned counsel appearing for all the respondents.
Learned counsel for the petitioner states that the petitioner has taken loan of Rs. 43,000/- in the year 2008, but due to serious illness, the petitioner could not deposit the said loan amount. Thereafter, the Bank has issued auction notice dated 19.03.2018 for auction of the mortgage agricultural land. He further states that the petitioner is ready to deposit the outstanding loan amount in easy instalments.
Sri Rohit Yadav, learned counsel for the Bank has no objection. He states that the Bank is ready to settle the dispute between the parties through one time settlement.
In view of the above, the petitioner is directed to approach the concerned Bank for redressal of his grievance, who shall apprise the petitioner of the outstanding dues under O.T.S. Scheme within a period of three days from today and the petitioner is directed to honour the O.T.S. demand within a further period of three weeks. For a period of one months, no coercive steps be taken against the petitioner.
Failure to deposit the amount within time as stated above, will leave it open to the respondent-Bank to proceed in accordance with law.
With the aforesaid observations, the writ petition stands disposed of.
