This application u/s 482 Cr.P.C. has been filed for quashing the entire criminal proceedings of Case Crime No. 265 of 2017, under Sections 376D, 313, 506 IPC and Section 5M/6 of POCSO Act, Police Station Mauaima, District Allahabad.
From the perusal of the F.I.R., it appears that on the basis of the allegations made therein prima facie cognizable offence is made out. There is no ground for interference in the FIR. Therefore, the prayer for quashing the impugned FIR is refused.
However, considering the facts and circumstances of the case, it is directed that in case the applicant surrenders before the court concerned within a period of 30 days from today and apply for bail, the same shall be considered and disposed of expeditiously in accordance with law.
With this direction, this petition is finally disposed of.
