JUDGMENT / ORDER

Petition filed under Section 438 of Code of Criminal Procedure. 2. According to the petitioner, he is apprehending arrest in connection with Crime No.1845/2014 of the Thiruvalla Police Station, registered for the offences under Sections 447, 436, 294 (b) and 427 of the Indian Penal Code.
3. It is alleged that the petitioner had enticed the daughter of the de-facto complainant and subsequently he married her. Thereafter, demands were forwarded to the de-facto complainant, who is an old woman aged 85, to part with a portion of her property as share of her daughter. She had complied with it and the petitioner had put up a building in the property and has been residing just adjacent to the building, in which the de-facto complainant was residing. The old woman was being tortured and harassed to the maximum by the petitioner/son-in-law by demanding money from her meagre pension, which she is getting and also the balance property. During the intervening midnight of 12.9.2014 and 13.9.2014, the petitioner came to the house of the de-facto complainant, threatened and intimidated her and she had to run away from the house. She took shelter in the neighbouring house. Just after mid night by 1 a.m., she heard some sounds and when she came out she could see the petitioner setting fire to her house. The house gutted in fired and became totally destroyed.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. The contents of the C.D. Prima facie reveal the complicity of the petitioner. The allegations against the petitioner are very grave and serious. There is absolutely nothing to disbelieve the versions of the 85 year old woman, in the matter.
The investigation has a long way to go. Considering the seriousness of the allegations against the petitioner and the present stage of investigation, I am satisfied that the petitioner is not entitled to the discretionary relief of anticipatory bail.
In the result, this bail application is dismissed.
