JUDGMENT / ORDER

The petitioner is aggrieved by the rejection application filed for remitting the commission report and plan. The suit is one filed for fixation of boundary and the petitioner's contention is that the Commissioner has failed to locate the boundaries and the commissioners report has to be remitted for locating the boundaries. The application filed is evident from Ext.P5 and the order rejecting the same is Ext.P6. The petitioner would be free to examine the commissioner at the time of trial and if the Court is of the opinion after examination of the commissioner, as also considering the arguments of the petitioner that the same has to be remitted, necessarily, the report would have to be remitted de hors the findings in Ext.P6. With the above observation the original petition is disposed.
