Heard learned advocate for the applicant.
In presence of the applicant, it is submitted that the applicant is ready and willing to deposit Rs. 60,000/-, the original amount of cheque, which is the subject matter of revision application and further 9% simple interest from the date of the cheque / filing of criminal case which also comes around Rs. 60,000/-, for which, another draft is prepared.
Upon depositing both the above drafts with Registry, High Court of Gujarat of Rs.60,000/- each, issue Notice returnable on 14.6.2012.
Learned APP, waives service of notice on behalf of respondent No.2.
Meanwhile by way of ad-interim relief the impugned order dated 11.5.2012 passed in Criminal Appeal No. 14 of 2004, by which, order dated 14.9.2004 passed in Criminal Case No. 719 of 2001 by learned Judicial Magistrate First Class came to be confirmed, shall remain stayed.
Direct service today is permitted.
