The petitioners were awarded compensation by the Motor Accident Claims Tribunal in M.A.C.P. No. 201 of 2008. The award was challenged by the insurance company by filing First Appeal From Order No. 319 of 2010 which came to be dismissed by order dated 8.1.2019 and the cross objection preferred by the petitioners was allowed and the insurance company was directed to pay the enhanced amount of compensation within a specified period.
This petition has been filed for a direction upon the District Magistrate, Kanpur Nagar to recover the awarded amount from the insurance company pursuant to the judgement and award passed by the Motor Accident Claims Tribunal as modified by this Court.
It appears from the record that for execution of the award already proceeding has been instituted in the Motor Accident Claims Tribunal, Kanpur Nagar, and those proceedings are, reportedly, pending. The ordersheet of those proceeding reflects that the last date fixed was in the month of May, 2021.
In view of the above, we deem it appropriate to dispose off this petition by requiring the concerned Tribunal to ensure that the execution proceedings are brought to its logical conclusion expeditiously, preferably, within three months from the date a copy of this order is produced in its office, unless there is any legal impediment in completion of those proceedings.
