Shri.Deep Chand Singh, learned counsel appearing on behalf of the petitioner submits that the petitioner who is the wife of defendant has filed a Matrimonial Suit No.666 of 2015, (Smt. Radha Vs. Gopal Rungta) under Section 13 of the Hindu Marriage Act. He further submits that as per the provisions of the Hindu Marriage Act, the said suit shall be decided expeditiously. He further submits that issues have been framed way-back in the year 2018.
Considered the submissions made at bar and perused the record.
This writ petition stands disposed of with the direction upon the learned court below to decide the Matrimonial Suit No.666 of 2015, (Smt. Radha Vs. Gopal Rungta) under Section 13 of the Hindu Marriage Act within a period of six months from the date of filing a certified copy of this order before it, without granting any unnecessary adjournment to either of the parties in view of Section 21-B of the Hindu Marriage Act, 1955.
While deciding the above-mentioned matrimonial suit, the learned court below may also take into consideration the judgment passed by the Hon'ble Supreme Court in the matter of M/s. Shiv Cotex Versus Tirgun Auto Plast P. Ltd and others 2011 (89) ALR, 232.
