The writ petition has been filed for mandamus directing the respondents to pay terminal dues as well as family pension to the petitioner.
It has been stated that Harbans Singh, husband of the petitioner was appointed as Tube Well Operator in UP Jal Nigam. He was convicted in a criminal case on 20.8.2015 and was sent jail. Thereafter he was murdered on 23.10.2017 at the Jail. As no disciplinary proceeding has been taken against the husband of the petitioner as such after his death, the petitioner is entitled for terminal dues as well as family pension in his place. The petitioner has moved a representation on 20.12.2017 in this respect, which is pending.
The writ petition is disposed of with direction to Executive Engineer, respondent-2 to decide the representation of the petitioner dated 20.12.2017 by reasoned and speaking order within a period of two months from the date of producing certified copy of this order.
