Following orders were passed in the matter on 14th August, 2018:
"An order of suspension dated 5.6.2018 is challenged on the ground that petitioner had duly submitted report in all matters and it was on account of inaction on part of the higher authorities that directions of the court could not be complied with. It is also stated that authorities have not served a charge sheet upon the petitioner even after expiry of sufficient period.
Learned Standing Counsel may obtain instructions, by the next date fixed. Put up in the additional cause list on 23.8.2018."
Learned Standing Counsel has obtained instructions, copy of which has been given to the learned counsel for the petitioner. As per the instructions, charge-sheet has already been served upon the petitioner on 11th July, 2018, to which, petitioner has already submitted his reply on 30th July, 2018.
It is stated that inquiry itself shall be concluded against the petitioner expeditiously.
In view of the fact that charge-sheet has been served and a reply has already been submitted, this Court is not inclined to examine the contentions raised on behalf of the petitioner with regard to seriousness of charges or the materials relied upon, at this stage.
Ends of justice would be met in directing the disciplinary authority to conclude the inquiry against the petitioner within a period of three months from today.
With the above observations/directions, this petition stands disposed of.
