Heard the learned counsel for the petitioner and Shri A.K. Mishra appearing for the respondent Bank.
By this writ petition the petitioner prays for a writ of mandamus directing the trial court to decide the temporary injunction application filed in Suit No. 272 of 2009. Copy of the order sheet has been filed as Annexure '7' to the writ petition.
A perusal of the order sheet indicates that all the defendant-respondents have not yet been served and the plaintiff-petitioner has been directed to take steps. The defendant-respondents having not yet been served, no order, as prayed, can be issued. It shall however be open for the petitioner to press his application after the defendants are served.
With the aforesaid observations the writ petition is dismissed.
