It appears from the record that earlier this Court (Coram: K.M. Thaker, J.) by an order dated 24.1.2012 has issued notice returnable on 12.3.2012. On 12.3.2012 considering the fact that the respondent Company was recently served, to give one more chance, the matter was kept on 19.3.2012. On 19.3.2012, inspite of service of notice of this Court and inspite of granting one more chance, no one appeared on behalf of the respondent Company, nor any response was given by the respondent Company and hence, this Court has admitted the matter and the publication of the advertisement was deferred till 28.3.2012. Again by an order dated 30.3.2012, the petitioner was directed to serve copy of earlier order dated 19.3.2012 as well as the order dated 30.3.2012.
Mr.
Brahmbhatt, learned advocate for the petitioner states that the respondent Company has been served. Today when the matter is called out, no one appears on behalf of the respondent. Hence, the advertisement for hearing of this petition be published in two daily newspapers, namely, "Divya Bhaskar", Gujarat daily and "Times of India", English daily, both Surat editions. The advertisement shall also state that the petition shall be heard for final hearing on 25.6.2012. Publication in the official gazette is dispensed with.
