Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, directing the 2nd respondent to re-issue the legal heir certificate in accordance with Indian Succession Act, 1925 in accordance for the death of D.Jeevanesan as claimed in the representation dated 01.08.2017.
For Petitioner : Mr.K.Mohana Murali For Respondents : Mr.S.N.Parthasarathy Government Advocate O R D E R Mr.S.N.Parthasarathy, learned Government Advocate, takes notice for the respondents. By consent, the main writ petition itself is taken up for disposal at the admission stage itself.
2. The petitioner has filed the above writ petition to issue a Writ of Mandamus, directing the 2nd respondent to re-issue the legal heir certificate for the death of D.Jeevanesan as claimed in the representation dated 01.08.2017.
3. Mr.K.Mohana Murali, learned counsel appearing for the petitioner submitted that it would be suffice to direct the 2nd respodnent to consider the petitioner's representation dated 01.08.2017 and pass orders, in accordance with law.
4. Mr.S.N.Parthasarathy learned Government Advocate, appearing for the respondents submitted that the 2nd respondent may be directed to consider the petitioner's representation dated 01.08.2017 and pass orders, in accordance with law.
5. Having regard to the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the 2nd respondent to consider the petitioner's representation dated 01.08.2017 and pass orders, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With this observation, the writ petition is disposed of. No costs.
