Heard Sri Sushil Kumar Pandey, learned counsel for the petitioners and Sri Abhijeet Mukherjee, learned A.G.A. for the State.
The present habeas corpus petition has been preferred for issuance of direction to the respondents no.4 to 7 to produce the corpus - Smt. Rabiya (petitioner no.1) before this Court and custody of corpus may be handed over to petitioner no.2 - husband.
Learned counsel for the petitioners submits that the petitioner no.1 is the legally wedded wife of petitioner no.2 and she is in the illegal detention of her parents, i.e., respondents no.4 to 7.
Learned A.G.A. has pointed out that as has been stated by learned counsel for the petitioners that the petitioner no.1 is legally wedded wife of petitioner no.2, then he has a remedy to file a suit for Restitution of Conjugal Rights before the competent court.
Accordingly, this writ petition is dismissed accordingly.
