The accused are facing investigation and apprehending their arrest pursuant to the F.I.R. registered as Case Crime No.57 of 2021 dated 10.3.2021 under Section 420, 467, 468 & 471 of I.P.C. at Police Station, Gagalhedi, Saharanpur and by way of this writ petition, the petitioners seeks quashment of the aforesaid F.I.R. or a direction by this Court upon the respondents not to coercively deal with the petitioners during investigation.
Learned counsel for the petitioner, on being told that, there are certain disputed questions of facts involved and, therefore, we are not inclined to grant the above prayers, seeks permission to withdraw this writ petition with liberty to move the Court of competent jurisdiction for alternative remedy for enlargement on bail/anticipatory bail.
He is permitted to withdraw this writ petition.
In view of the above, this writ petition is dismissed as withdrawn.
At this stage we feel that there are certain disputed questions of facts which we would not like to go into. The incidents are now very old and are in a chequered history. All these facts may be considered by the Court of competent jurisdiction where the petitioners may move for bail/anticipatory bail. This petition shall also be annexed with the said application.
