JUDGMENT / ORDER

. Respondent/Respondent Petition under Section 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner/ accused No.3 on bail in Cr.No.24/2014 on the file of Station House Officer, Yadamari Police Station, Chittoor District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri V.Lakshmi Harish, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioner is A3. He seeks for grant of bail. He allegedly committed offences under Section 307, 353 and 379 IPC as well as under the provisions of the Andhra Pradesh Forest Act, Andhra Pradesh Sandal Wood and Red Sanders Wood Transit Rules, Wild Life Protection Act and Biological Diversity Act as well as under the Arms Act. It is the case of the prosecution that when the petitioner along with others was transporting red sandal wood unauthorisedly, the police party intercepted the transporting of red sandal wood and that there was an attempt on the part of the accused to run away. It is also the case of the prosecution that some of the accused pelted stones at the police party at that time. It would appear that no serious injury was caused to anyone. The learned Additional Public Prosecutor submitted that even sickles were recovered from the auto driven by the petitioner. Be that as it may, there is no allegation that the sickles were used in attacking the police party. In view of these circumstances, I consider it appropriate to enlarge the petitioner on bail. However, in view of the nature of the offence, I consider it appropriate to enlarge the petitioner on bail on terms only.
Accordingly, this petition is allowed. The petitioner is enlarged on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to the satisfaction of learned IV Additional Judicial Magistrate of First Class, Chittoor. After his release, the petitioner shall appear before the Station House Officer, Yadamari Police Station, Chittoor District, on every Monday, Wednesday and Friday between 9.00 a.m. and 6.00 p.m. till 30.05.2014.”
