2. R.Suresh ... Respondents in both CRPs Civil Revision Petitions filed under Article 227 of the Constitution of India, against the orders dated 24.03.2017 made in Transfer O.P. S.R.Nos.2413 of 2017 & 2416 of 2017 (unnumbered) on the file of the Principal District Judge, Chengalput.
For Petitioner : Mr.V.Manohar COMMON ORDER The above Civil Revision Petitions have been filed by the revision petitioner, challenging the docket orders dated 24.03.2017 returning the Transfer Original Petitions in Transfer O.P. S.R.Nos.2413 of 2017 & 2416 of 2017, on the file of Principal District Court, Chengalput, on the ground that it has no territorial jurisdiction over Kancheepuram, Uthiramerur and Sriperumbudur Taluk.
2. Mr.V.Manohar, learned counsel appearing for the petitioner submitted that the Principal District Judge has not given an opportunity to the petitioner to make her submissions with regard to maintainability of the Transfer Original Petitions before the Principal District Court, Kancheepuram.
3. In view of the submission made by the learned counsel appearing for the petitioner, I am of the view that the petitioner can be given an opportunity to make her submissions with regard to maintainability of the Transfer Original Petitions before the Principal District Court, Kancheepuram.
4. Accordingly, I give liberty to the petitioner to make her submissions with regard to maintainability of the Transfer Original Petitions before the Principal District Court, Kancheepuram, within a period of one week from the date of receipt of a copy of this order. After hearing the submissions made by the learned counsel for the petitioner, with regard to maintainability of the Transfer Original Petitions, the Principal District Court, Kancheepuram, shall decide the issue with regard to maintainability of the Transfer Original Petitions and pass suitable orders.
With these observations, the Civil Revision Petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
24.03.2017 Index : Yes/No Note : (i) Registry is directed to return the original Transfer O.P. S.R.Nos.2413 of 2017 & 2416 of 2017 to the learned counsel for the petitioner.
