ORDER:
This writ petition is filed for a mandamus to set aside proceedings in Roc.No.B/8634/2014, dated 01.11.2014, of respondent No.2, whereby he has suspended the petitioner’s fair price shop authorisation.
Having regard to the allegation that there is substantial variation in the quantity of PDS rice, I am not inclined to interfere with the impugned order. However, respondent No.2 is directed to hold a detailed enquiry, wherein he shall furnish a coy of the report, dated 22.09.2014, of the Tahsildar, Chittoor referred in the impugned order to the petitioner. He shall also peruse the registers maintained by the petitioner and hold a personal enquiry instead of relying upon the purported enquiries conducted by his subordinate officers; make an objective and rational approach and pass a speaking order at the end of the enquiry. He shall complete this exercise within a period of two months from the date of receipt of a copy of this order.
Subject to the above directions, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.46809 of 2014 shall stand disposed of as infructuous.
