The writ petition is filed for a mandamus declaring the action of the respondents in trying to terminate the fair price shop dealership held by the petitioner in Korrevue village, Amarapuram Mandal, Ananthapur District without issuing any notice or any reason as illegal and arbitrary and for a consequential direction to the respondents to continue the petitioner as fair price shop dealer of the said village.
2. The case of the petitioner is that he was appointed as a fair price shop dealer of Korrevue village, Amarapuram Mandal, Ananthapur District and he has been distributing the commodities to the card holders without any complaint since from the date of his appointment and his authorisation is valid and subsisting. It is stated that the 4th respondent refused to receive the cheques deposited by the petitioner for issuance of commodities for the month of August, 2014 and instructed that he will not issue commodities for the current month without any reason. Aggrieved by the said action, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. Since it is stated that the authorisation of the petitioner is valid and subsisting as on today, which is not disputed or denied by the learned Assistant Government Pleader, the respondents are directed to supply the stocks to the petitioner as long as his authorisation is valid and subsisting. However, this order will not preclude the respondent authorities from taking any action in case the petitioner commits violation of Control Order 2008.
5. With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
