JUDGMENT / ORDER

HON’BLE SRI JUSTICE C.V.NAGARJUNA REDDY Writ Petition No.33260 of 2014 Date:07.11.2014 Between: R.Srinivasulu, S/o R.Nagaiah And The A.P. Transco Ltd., reptd., by its Chairman and Managing Director, Hyderabad and three others.
.. Petitioner .. Respondents Counsel for the petitioner: Sri G.Venkateswarlu Counsel for the respondents: Sri P.Vinod Kumar The Court made the following:
ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.2 to 4, in interfering with the process of recruitment and engagement of employees by the petitioner in connection with the operation and maintenance works at 33/11 KV Sub- station Rayavaram, Markapur Rural, Prakasam District as illegal and arbitrary.
A perusal of the averments in the affidavit shows that they are generic and vague without specific instances of the alleged interference by respondent Nos.2 to 4 in the matter of selection and appointment of personnel by the petitioner for maintenance of 33/11 Sub-station Rayavaram, Markapur Rural, Prakasam District.
Under Clause-24 of the agreement between the petitioner and the respondents, it is clear that the personnel employed by the petitioner are his employees only and they have nothing to do with respondent No.2. Therefore, I have no reason to believe that respondent Nos.2 to 4 have been in any manner recommending the candidates of their choice and have been withholding the payments on the ground that the petitioner has not been obliging them.
If the petitioner has any such grievance, he is entitled to make a representation in writing to respondent No.3 for redressal of his grievance. If the petitioner’s grievance is not redressed by respondent No.3, after such representation is made, he shall be free to avail an appropriate remedy.
Subject to the above observations, the Writ Petition is disposed of.
As a sequel, WPMP.No.41598 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
