This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.3 and 4, in withholding the supply of essential commodities to fair price shop No.03082, Gollagudem, H/o.Velugumatla, Khammam District, even though the petitioner’s authorization in respect thereof is subsisting, as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Civil Supplies (TS), on instructions from the respondents, submitted that by proceeding in Rc.No.C2/8158/2014, dated 18- 11-2014, respondent No.3 has suspended the petitioner’s authorization pending enquiry.
In view of the aforesaid fact, the premise, on which this Writ Petition has been filed, turned out to be incorrect. Therefore, this Writ Petition is dismissed with liberty to the petitioner to avail appropriate remedy, if he feels aggrieved by the aforesaid order of suspension pending enquiry.
As a sequel, WPMP.No.44087 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
