This writ petition is filed seeking a mandamus to declare the action of the respondents in not receiving the application for supply of power connection to the petitioner’s house bearing House No.7-1-178, Martuveedhi, Secunderabad as illegal and arbitrary and for a consequential direction to direct the respondents to receive the application and process the same for giving power supply to the petitioner’s house.
2. The case of the petitioner is that the petitioner is a tenant of House bearing No.7-1-178, Martuveedhi, Secunderabad. It is stated that the owner of the house let out a portion of the house to Tutorial College, due to which the service connection was converted from domestic to commercial, for which the Electricity Department collected huge amounts from the petitioner. Thereafter, the petitioner made an application on 25-09-2013 to the respondents for grant of new service connection to his portion, enclosing all necessary documents, but the respondents refused to receive the said application for providing power supply to his portion. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and Sri O. Manohar Reddy, learned standing counsel for the respondents.
4. Having regard to the facts and circumstances of the case and having heard the learned counsel for both parties, I deem it appropriate to direct the respondents to receive the application of the petitioner for grant of new service connection to his portion, subject to the petitioner submitting the application in proper proforma by fulfilling the conditions as laid down by the Regulations and pass appropriate orders in accordance with law.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
