THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.25407 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Endowments (AP) appearing for the respondents.
This writ petition is filed for a mandamus, declaring the inaction of the first respondent in not considering the representation of the petitioner dated 27-6-2014 for extending the existing time scale in the cadre of Junior Assistant to the petitioner as illegal, arbitrary and violative of The Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 etc., and consequently direct the first respondent to extend the existing time scale in the cadre of Junior Assistant in the existing vacancy to the petitioner.
It is submitted by the petitioner that he was initially appointed as Computer Operator on 1-4-2011 in the establishment of Sri Kukkuteswara Swamy Temple, Pithapuram Town and Mandal, East Godavari Distirct on a consolidated pay of Rs.3,000/-. Thereafter his pay was enhanced to 5,000/- with effect from 1-3-2012 by the proceedings of the Regional Joint Commissioner, Endowments Department, Multi Zone-I, Kakinada and the said pay was enhanced to Rs.7,000/- with effect from 1-1- 2013. Thereafter, the petitioner was treated as Computer Operator-cum-Clerk with effect from 1-5-2013.
It is further submitted that the petitioner was sent on deputation to the first respondent establishment as per the proceedings of the Commissioner, Endowments Department, Hyderabad dated 2-4-2014. The pay of the petitioner was enhanced from Rs.7,000/- to Rs.9,000/- with effect from 1-6-2014. The petitioner made a representation dated 27-6-2014 to the first respondent for extending the time scale to the petitioner in the existing vacant post of Junior Assistant and the said representation is pending consideration with the first respondent.
In the circumstances stated by the petitioner, the first respondent is directed to consider the representation of the petitioner dated 27-6-2014 for extending the existing time scale in the cadre of Junior Assistant in the first respondent establishment in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
