RESPONDENTS This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to direct the R-3 to issue the Work Certificate to the petitioner by considering the application at Annexure-D dated 23.2.2019 and etc.
This Writ Petition coming on for Preliminary Hearing, this day, the Court made the following:-
ORDER Sri. Devi Prasad Shetty, learned counsel for the petitioner.
Taking into account the order which this Court proposes to pass, it is not necessary to issue notice to the respondents.
2. In this petition, the petitioner inter alia has prayed for the following reliefs:
“1. Issue a writ in the nature of mandamus directing the respondent No.3 to issue the work certificate to the petitioner by considering the application at Annexure-D dt.23.2.19.
2. Issue a writ in the nature of mandamus directing the respondent No.3 to consider the work order as experience certificate/work certificate issued by the respondent No.3 for all the previous years as per Annexure – C dated 30.3.2005 in No.SA KA A(VA) PR.141/04-05, Annexure C1 dated 22.09.2006 in No.SA KA A(VA) PR.145/04-05, Annexure C2 dated 22.09.2006 in No.SA KA A(VA) PR.145/05-06, Annexure C3 dated 22.09.2006 in No.SA KA A(VA) PR.145/05-06, Annexure C4 dated 22.09.2006 in No.SA KA A(VA) PR.145/05-06, Annexure C5 dated 1.03.2006 in No.SA KA A(VA) PR.141/1/06-07, Annexure C6 dated 08.05.2007 in No.MCC A.E/KRU U V/3/07-08, Annexure-C7 dated 29.07.2009 in No.MYNAPA/KA A/VAVINISA(V)/DM.2/TANKER/2009-10/1798, Annexure-C8 dated 09/02/2017 MYNAPA/KA A/VAVINISA(V)SA.A/TANKER/2016-17/637 while processing the tender application of the petitioner in pursuance of the tender notification at Annexure-A dated.1.3.09.”
3. When the matter was taken up today, learned counsel for the petitioner submitted that the Writ Petition be disposed of with a direction to respondent No.3 to issue Work Certificate to the petitioner by considering the application submitted by the petitioner dated 23.02.2019.
4. In view of the aforesaid submission and facts of the case, Writ Petition is disposed of with a direction to respondent No.3 to consider and decide the application submitted by the petitioner dated 23.02.2019 for issuance of Work Certificate by a speaking order in accordance with law within a period of ten days from the date of receipt of certified copy of this order passed today.
It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, petition is disposed of.
