For Petitioner : Mr.T.Sundaravadanam For Respondent : Mr.C.Emalias, APP ORDER This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate No.II, Salem to expedite the trial in CC No.446 of 2009 on day to-day basis within the stipulated time as may be fixed by this Hon'ble Court.
2. The grievance of the petitioner is that he is arrayed as A8 in CC No.446/2009 on the file of the learned Judicial Magistrate No.II, Salem and the said case is pending from 23.03.2010 for execution of non bailable warrant. Hence, this petition.
3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor, on instructions, submitted that the non-bailable warrant came to be executed on 01.02.2017.
4. In view of the said submission made by the learned Additional Public Prosecutor, this Court is of the view that there is no difficulty for the learned Judicial Magistrate No.II, Salem to complete the trial and dispose of the case in CC No.446/2009 pending on its file. The disposal shall take place as expeditiously as possible. Accordingly, this Criminal Original Petition is disposed of.
