1. Pursuant to this Court's order dated 17.01.2019, notice was issued to petitioner to engage another counsel. Perused Office Report dated 27.02.2019. Service is deemed sufficient. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(a) issue a writ, order or direction in the nature of mandamus commanding the respondents to pay the following retirement benefits to the petitioner.
(i) C.P.F. - Rs. 1,47,966/- admissible up to 31.07.2003.
(ii) Amount of Gratuity Rs. 1,52,420/-.
(iii) Interest of the gratuity Rs.82306/- upto 31.07.203 with 12% interest.
(iv) Leave encashment Rs. 92005/-
(v) Interest Rs. 49643/- upto 31st July, 2003 at the rate of 12% on leave encashment.
(vi) Future interest on the aforesaid amount at the rate of 12% till the amount is not paid to the petitioner."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
