JUDGMENT / ORDER

Petition under Sections 437 & 439 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on Regular Bail to the Petitioner/accused No.5 in Crime No. 36 of 2014 on the file of Puttur P.S., Chittoor District, dated 03-03-2014 The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri Challa Ajay Kumar, Advocate for the Petitioner and of the Public Prosecutor on behalf of respondent- State, the Court made the following ORDER:-
“The petitioner is A5. He seeks for grant of bail. He allegedly committed offences under Section 353, 307 and 379 or 411 IPC read with Red Sandalwood Transit Rules, Andhra Pradesh Forest Act, Biodiversity Act and Arms Act. It is the case of the prosecution that when the petitioner and other accused were smuggling red sandal wood, the police party intercepted the smuggling activity and that when the accused and his group became wild, the police opened fire. In any event, there was no injury to any of the police officials. In view of the fact that there are no injuries to the police party, I consider it appropriate to enlarge the petitioner on bail.
The petitioner does not belong to the state of Andhra Pradesh although the offences occurred within the jurisdiction of Puttur police station. I therefore consider it appropriate to enlarge the petitioner on bail on special terms only.

Accordingly, this Petition is allowed. The petitioner is enlarged on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to the satisfaction of the learned Additional Judicial Magistrate of First Class, Puttur, subject to the condition that after his release, the petitioner shall appear before the Station House Officer, Puttuur Police Station, Chittoor District, on everyday between 9.00 a.m. and 6.00 p.m. for a period of three months.”
