This Criminal Petition is filed to quash proceedings in DVC.No. 18 of 2011 on the file of Special Mobile Magistrate Court, Guntur.
2. This Court permitted the petitioner to take out fresh notice to first respondent by registered post with acknowledgement due on 09/10/2012 and since then proof of service is not filed. On 30/10/2012 on the request of counsel for petitioner time was extended till 16/11/2012, thereafter, matter is not listed. Today when the matter is posted under the caption of dismissal, advocate representing petitioners advocate submitted that acknowledgement is not received for the notice sent by registered post. I am not inclined to accept the submission of counsel for the petitioner, since notice was ordered in October 2012 and it is unbelievable that acknowledgement is not received for over a period of two years. Advocate for Petitioners has not filed at least registered post receipt to support his submission.
Therefore, this Criminal Petition is dismissed for non-compliance of order.
